The selection of Brett Kavanaugh for the Supreme Court will have less of an impact on November's midterms than you think.
Kavanaugh, in contrast, has consistently questioned the relevance of global law in shaping the executive's war powers and construing legislative authorizations. You don't want people to think that this is just another way to do politics. But not from courts-from Congress. At the event, Senate Minority Leader Chuck Schumer said that he will fight the nomination "with everything I've got". Booker (D-NJ) have extrapolated his position into "Get Out Of Jail Free".
"From one perspective", he wrote, assessing the abortion debate, "some disagree with cases that allow the Government to refuse to fund abortions and that allow the Government to impose regulations such as parental consent, informed consent, and waiting periods". Each comes from a state that went for Trump.
Pence, who is also president of the Senate, called Kavanaugh a "good man" and "quite simply the most qualified and the most deserving nominee to the Supreme Court of the United States".
Trump "chose the candidate who he thought would best protect him from the Mueller investigation", Schumer said, adding that Kavanaugh has written that a president should not be investigated and could choose not to follow the law if he deemed it unconstitutional.
Still, this is the reality on Kavanaugh, according to Schoen: "Even if every Democrat votes against Kavanaugh, he will still be confirmed if no Republican votes against him".
As the Washington Post's correction admitted, however, their initial suggestion that Kavanaugh had non-home assets of only $15,000-$65,000, and would therefore have less than one tenth the wealth of the next poorest justice, is wildly inaccurate, failing to take into account the above mentioned retirement account.
West Virginia Democratic Senator Joe Manchin, battling for reelection in a state Trump won in 2016, in a statement on Kavanaugh's nomination, said the "Supreme Court will ultimately decide if almost 800,000 West Virginians with pre-existing conditions will lose their healthcare".
One key swing vote, Sen. But, unlike presidents or members of Congress, Supreme Court justices do not have term limits - they serve until they resign or die. It's theoretically possible that Trump appointee Neil Gorsuch is in on the scheme, but Roberts? He is prepared, it seems, to vote to confirm Kavanaugh if the judge's rulings and writings are no more extreme than Gorsuch's. (Thomas was confirmed in 1991, Trump and Ivana split up in 1992).
Unlike some of the other justices, Kavanaugh has worked more than two decades in the public sector and has not built wealth as a private lawyer. Trump spoke during the television announcement of the nomination from the White House East Room on Monday.
Republicans are pushing for a bipartisan showing of support for Kavanaugh by trying to peel off Democrats who are up for re-election from Trump-won states. And since the president of the moment is Donald Trump, the ideology is converted into corruption. "From the other perspective, some disagree with cases holding that the U.S. Constitution provides a right to an abortion".
With Senate Republicans holding open the seat of the late Justice Antonin Scalia until after the presidential election, Trump was assured his first pick even before he took office. Their certainty - and outrage - that one man will have the power to dispense rights they view to be nonexistent, and dispense with others they consider inalienable, only shores up a fact that the left will nearly never admit: the federal government has far too much power.
